Calendars of hearings by both Justices of the Peace are uploaded every day. They include hearing start time, the type (status hearing, order of protection, initial appearance, etc) and the name of the person to appear.

Types of Hearings

  • NEW TICKETS: If you received a ticket, you may not need to physically come to court. Please call the clerk to schedule an appearance or learn about paying online. Contact us for more information.
  • Justice Court prefers (but does not require) that everyone personally appear for hearings, especially initial appearances and sentencings in criminal cases. Certain hearings will require in person appearances. Contact the clerks’ office to find out if you need to appear in person.

  • Law and Motion: The Court strongly prefers that parties appearing remotely use Zoom video, with a screen name that clearly identifies them. If a defendant chooses to appear via Zoom telephone, they have waived their right to see and be seen per MCA § 46-12-201 & -211. Parties do not need to physically appear at the courthouse unless (1) they are instructed to do so by the Judge or a court clerk, or (2) are set for a change of plea, sentencing, or other dispositive hearing.
  • Witnesses: Requests for parties or witnesses to appear remotely for trials or hearings should be submitted at least 14 days in advance unless the matter is unopposed. If the matter was scheduled less than 14 days in advance, requests should be submitted as soon as possible. Requests should note whether the opposing party or attorney objects. Opposing parties should respond as quickly as possible.

  • Law and Motion: Persons are encouraged to appear via Zoom video for pretrial & status conferences, and other non-dispositive hearings.
  • Bench trials: Unless good cause is shown, all parties must be physically present in the courtroom.
  • Standard for remote appearance: If parties, or witnesses wish to appear remotely for a hearing or trial, those persons must have access to all exhibits. So long as a witness has access to an exhibit, whether via a “shared screen” in Zoom or a physical copy, this obligation has been met.
  • Civil jury trials have lower priority on the Court’s calendar than criminal jury trials but have resumed.
  • Mediations: Effective August 1, 2021, mediations will be occurring both in person and via Zoom. At the time mediation is set, the parties should discuss with the Court whether in person or remote is desired.

  • Initial appearances at 1:30 p.m. and jail court at 2:30 p.m. are visible via Zoom. Interested persons or members of the media may join the Zoom.
  • Jail appearances. Jail appearances are conducted by, and may be viewed via, Zoom. Persons other than the prosecutor and attorney for the current detainee should keep their video off. The Court grants permission to the media to rebroadcast those hearings without additional permission. The Court encourages broadcast media to be judicious with such images. While the Court will permit media to appear in person in the courtroom, they should be aware that the Zoom feed is generally better than what they would capture in person.
